Calvert County Strengthens Forest Protection Rules

Calvert County is making sure Maryland's trees get a fighting chance when new construction comes to town.

The county just updated its forest conservation policy to match new state requirements, changing how developers must handle trees during construction projects. Under the new rules, builders generally must replant one acre of forest for every acre they remove, replacing a complicated scaling formula that often allowed less replanting.

The change affects any construction on lots 40,000 square feet or larger. The simpler one-to-one replacement rule means communities can better track what's being lost and what's coming back.

"The state's intention with these changes was to strengthen the forest conservation requirements, not weaken them," said zoning planner Will Hager. The policy updates came from Senate Bill 526, passed in 2023 to boost tree protection across Maryland counties.

The new rules also add bonuses for developers who preserve historic trees during construction. That means those majestic old oaks and towering pines that define neighborhoods now have extra protection.

While the policy requires developers to replant within the same county, it follows a smart hierarchy that puts nature first. Builders must start by minimizing tree removal altogether, then replant on-site whenever possible.

If there's not enough room at the project site, reforestation moves to the same watershed. Only when developers can prove neither option works can they plant replacement trees elsewhere in the county.

Environmental planning regulator Colleen Brummitt explained that this approach balances practical development needs with environmental protection. "Everything has to stay in the county," she said, ensuring local forests benefit from local replanting efforts.

The policy passed 4-1, with commissioners acknowledging the need to comply with state law while protecting their unique county character. Some officials hope to fine-tune the rules after meeting with the Maryland Department of Natural Resources.
