China Rules Companies Can't Fire Workers to Use AI Instead

Imagine getting fired from your job because a computer could do it cheaper. In China, a court just said that's not allowed to happen.

The Hangzhou Intermediate People's Court ruled late last month that companies cannot fire workers just to replace them with AI automation. The case involved an employee who refused a demotion after his company automated his position, then got fired for refusing.

The court sided with the worker. Their reasoning? "Employers are prohibited from shifting operating costs to employees."

The ruling goes further, laying out a principle that puts workers first. Companies can use AI technology to improve efficiency and enhance employee welfare, the court stated. But they cannot use technological change as an excuse to unilaterally cut salaries or terminate contracts.

This decision stands out globally. While many countries grapple with how to handle AI's impact on employment, China has drawn a clear line protecting workers.

The timing matters too. Americans currently show high levels of distrust toward AI and concerns about job security. Meanwhile, China ranks as the third most trusting country toward AI globally, according to recent surveys, trailing only Nigeria and India.

This ruling could become a template for worker protections worldwide as AI adoption accelerates. It recognizes a simple truth: companies that profit from automation shouldn't force their employees to pay the price through job loss.

The court emphasized that technological progress should benefit workers, not just corporate bottom lines. Companies can still modernize and use AI, but they need to consider employee rights and welfare in the process.
