Court Secures $74K for Family After Tragic Bus Crash

When a 49-year-old autorickshaw driver died in a bus crash in March 2024, his family didn't just lose their loved one—they lost their sole source of income. Now, India's Orissa High Court has ensured his family will be taken care of, awarding them Rs 61.44 lakh (roughly $74,000 USD) in compensation.

Narayan Rath was riding a bus from Jeypore to Berhampur when the vehicle, driven rashly and negligently, capsized near Koraput. He died instantly, leaving behind his wife and four dependents, including his daughter Swagatika, who was still a minor.

The family approached the Motor Accident Claims Tribunal seeking compensation. The insurance company tried to fight the payout, claiming the bus driver didn't have a valid license, but couldn't provide any proof.

Justice G Satapathy carefully reviewed the case and found the insurance company's arguments groundless. The bus driver had a valid license and was driving an authorized route when the accident occurred.

What makes this ruling especially meaningful is how the court thought about the family's future. Using five years of income tax returns, the tribunal calculated that Rath earned Rs 4.98 lakh annually and added 25% for future earning potential, recognizing he was only 49 and had productive years ahead.

The Bright Side

The court went beyond just awarding money. Recognizing that Swagatika would turn 18 on April 1, 2026, Justice Satapathy ordered Rs 10 lakh (about $12,000) be placed in a fixed deposit in her name, with Rs 5 lakh paid directly to her when she reaches adulthood.

This thoughtful arrangement ensures the teenager will have financial stability as she begins her adult life. The fixed deposit will grow with interest, providing a foundation she can use for education, starting a business, or whatever dreams she chooses to pursue.

The family also received Rs 70,000 for funeral expenses and the emotional loss of love and companionship. The insurance company must pay the full amount within eight weeks, with 6% annual interest from the date the claim was filed.

The ruling recognizes something powerful: losing a family's breadwinner creates a ripple effect that lasts for years. By structuring the compensation to protect a young person's future, the court turned a tragic loss into a pathway forward for this grieving family.
