Indian Court Ends Veteran's 14-Year Disability Pension Fight

A former Indian Army soldier just won a 14-year fight for the disability pension he earned serving his country, and his victory could help thousands of other veterans.

NK Gurdeep Singh was discharged from the Indian Army in December 2011 after completing his service term. A medical board found his 20 percent disability was made worse by his military service, but authorities refused to increase his pension to the next benefit level of 50 percent, a process called "broad-banding."

Singh took his case to the Armed Forces Tribunal, which ruled in July 2022 that he deserved full benefits dating back to January 2012. The Indian government fought back, citing a 2018 internal circular claiming the benefit should only apply from January 2016 onward.

The Jammu and Kashmir and Ladakh High Court had none of it. Justices Sanjeev Kumar and Sanjay Parihar delivered a clear message: "An internal communication between the Government of India and the three Army Chiefs cannot change the law declared by the Supreme Court."

The judges pointed to a landmark Supreme Court case that established all armed forces members discharged with service-related disabilities deserve the rounding-off benefit from their discharge date. That ruling was what lawyers call "binding judgment," meaning it applies to everyone in similar situations, not just the original plaintiff.

In April 2016, India's Ministry of Defence had actually approved this exact interpretation, instructing all three service chiefs to grant the benefits. But the 2018 circular tried to reverse course, leaving countless veterans in limbo.
