Maine Expands Immigrant Privacy Protections Statewide

Maine is rolling out three new laws designed to protect immigrants and strengthen community trust in public institutions.

Starting this week, schools, libraries, healthcare facilities, and childcare centers across Maine cannot grant immigration officers access to nonpublic areas without a judicial warrant. The measure ensures families can seek medical care, education, and other essential services without fear.

A second law restricts local police and jails from assisting with civil immigration enforcement in most cases. Officers can no longer contact federal immigration authorities for translation services or share personal information for civil enforcement, though exceptions exist for serious criminal investigations.

The third law protects tenant privacy by preventing landlords from sharing residents' personal information, including immigration status, without consent. Emergency situations and legal requirements like warrants remain exceptions.

More than 50 people in lawful immigration processes with no criminal records were handed over to federal immigration authorities by Maine law enforcement last year alone, according to the Immigrant Legal Advocacy Project. The vast majority had committed no crimes.

Several Maine cities including Portland, Lewiston, and Waterville had already adopted similar local protections. The statewide laws now extend these safeguards to every community.

The Maine State Police announced last December they would begin following the new restrictions even before the official start date, setting an early example for other agencies.

Immigrant rights advocates say the laws will encourage families to report crimes, seek medical treatment, and engage with schools without risking separation. When communities feel safe accessing public services, everyone benefits from better public health, safer neighborhoods, and stronger schools.

The protections also allow law enforcement to focus resources on actual public safety concerns rather than civil immigration matters, which remain a federal responsibility.

Maine joins a growing number of communities nationwide choosing to prioritize trust between immigrants and the institutions that serve them.
