Nigeria's Top Judge Brings Reform to Grassroots Courts

Nigeria's Chief Justice is taking justice reform where it matters most: the courtrooms that serve everyday people.

Chief Justice Kudirat Kekere-Ekun has launched an ethics and accountability initiative targeting the country's lower courts, including Magistrates' Courts, Area Courts, and Customary Courts. These grassroots courts handle roughly 70 percent of Nigeria's legal cases, mostly for poor and rural residents dealing with tenancy disputes, debt recovery, family matters, and minor criminal cases.

For most Nigerians, these local courts represent their only realistic access to justice. Unlike superior courts, they're geographically accessible and affordable, designed to resolve everyday disputes quickly through summary proceedings.

But decades of neglect have undermined their mission. Many lower courts lack basic infrastructure like habitable courtrooms and decent facilities. Staffing shortages, underfunding, and administrative inefficiency have become the norm rather than the exception.

The human cost shows up in frustrated litigants and swelling case backlogs. Court staff sometimes solicit payments for services that should be free. Some magistrates have exceeded their legal authority or issued questionable warrants, including a notorious 2022 incident when armed agents raided a Supreme Court Justice's home based on a spurious warrant later voided by the issuing magistrate.

Justice Kekere-Ekun's ethics campaign directly addresses these systemic failures. By driving accountability standards down to the grassroots level, she's tackling the courts where reform can help the most people.

The initiative focuses on monitoring compliance with judicial codes of conduct, something rarely enforced at lower court levels. It also aims to improve service delivery standards and reduce the political and executive pressure that sometimes compromises judicial independence at this level.

When lower courts work properly, the benefits extend far beyond individual cases. Efficient grassroots justice reduces pressure on overburdened superior courts, allowing the entire judicial system to function better.

Court users deserve respectful treatment, accurate record-keeping, timely notifications, and decisions free from corruption or political influence regardless of which courtroom they enter.

By prioritizing courts that serve the poorest and most vulnerable Nigerians, Justice Kekere-Ekun is addressing a fundamental equity issue. When lower courts fail, wealthy litigants can escalate to superior courts, but ordinary citizens have nowhere else to turn.

The reform effort recognizes that true access to justice means more than having courts geographically nearby. It means those courts must actually function with integrity, efficiency, and respect for all who enter them.

While infrastructure improvements require funding and time, ethics and accountability reforms can begin immediately through better monitoring, training, and enforcement of existing conduct standards.
